Terms of Service

Scope and operator

Effective date: October 7, 2026

Skube Labs, Inc. operates Benchmark. Benchmark is based in the United States. These Terms cover benchmark.app, benchmark.social, our dashboard, API, MCP server, webhooks, content gallery, and documentation (the Service).

Benchmark provides public-content research, structured results, and curated examples. Public browsing and account features differ. Some features require an eligible paid plan. The plan and price presented before purchase govern your purchase.

The Acceptable Use Policy forms part of these Terms. The Privacy Policy explains our information practices. A privacy notice does not replace any separate consent required by law.

Acceptance and eligibility

When these Terms are presented to you, creating an account, accepting these Terms, or purchasing a plan constitutes agreement to them. If you act for an organization, you represent that you can bind it. That organization is responsible for its workspace and authorized users.

Accounts and paid features require you to be at least 18 years old. If the age of majority where you live is higher, that age applies. Public browsing is not directed to children under 13.

Accounts and security

Provide accurate registration and billing information and keep it current. Protect credentials, API keys, and webhook secrets. Your organization controls workspace membership and administrator permissions. You are responsible for activity you authorize through your workspace or connected clients.

Report suspected unauthorized access to security@benchmark.app. We may require reasonable verification before acting on account or billing requests.

Public content and results

Benchmark processes supported public profiles, posts, and customer-identified public web links. Basic results may contain public identity, text, state, and metrics. Enriched results may add structure, analysis, and selected source-text excerpts. API and MCP results do not provide stored source-media locations, full transcript artifacts, or a dedicated transcript field. Selected excerpts can reproduce a complete short script. Available fields are described in the documentation.

Benchmark.social may display curated examples, thumbnails, excerpts, embeds, and editorial analysis. Source content and results may be incomplete, inaccurate, outdated, removed, or unavailable. We do not guarantee a creative, research, audience, or business outcome.

Third-party content remains subject to its owners’ rights. Its presence in Benchmark does not authorize your reuse. Platform names and marks identify sources, and do not imply affiliation or endorsement. Links and embeds may be subject to third-party terms and privacy notices.

Subscriptions and renewal cancellation

The purchase screen shows the price, interval, included credits, features, and material restrictions. Subscription Checkout requires agreement to the presented Terms and recurring-charge conditions. Subscriptions renew automatically at the disclosed price and interval until renewal is canceled, subject to applicable notice requirements. Annual plans are charged up front. Their included credits become available monthly. Applicable taxes may be charged.

A workspace administrator can cancel renewal through Settings → Billing → Manage. Contact support@benchmark.app if you cannot complete cancellation. Canceling renewal stops future renewal charges and retains paid access through the paid-through date shown in billing settings. It does not delete the workspace. Work accepted before that date may finish, but new paid work requires a current eligible plan.

Consumer withdrawal rights

Mandatory consumer withdrawal rights may apply to your purchase. These rights are separate from canceling renewal or deleting a workspace. Where applicable, you may withdraw within the period provided by law. Contact support@benchmark.app with your name, account email, and the purchase concerned to communicate your decision or request assistance.

Any charge for service supplied before withdrawal must satisfy applicable notice and express-request requirements. We will provide refunds required by law. Using the Service does not by itself waive a mandatory withdrawal right.

Immediate workspace closure

An authorized administrator can request permanent workspace deletion. Before confirmation, Benchmark shows verified current-term payment information, the paid-through date, and remaining time when a paid subscription is present.

If you choose immediate deletion, you end workspace access before the paid term ends. You must expressly acknowledge that unused subscription time will not receive a prorated refund. Benchmark cancels the subscription before completing workspace closure. This rule does not limit refunds or other rights required by applicable law or a separately signed agreement. The payment shown is the amount paid for the reviewed term. It does not calculate a refundable or forfeited cash balance.

Immediate self-service closure is unavailable while purchased-credit value, accepted work, unresolved payments, debt, or other billing issues require resolution. Contact support in those cases. The subscription-time acknowledgment does not forfeit purchased top-up credits. Resolve those credits separately before permanent closure.

When confirmed closure begins, new work and purchases stop. A failure to finish closure may require processing or support review. Do not assume closure completed until Benchmark confirms it. Financial records and the administrator’s closure acknowledgment can remain after access ends, as described in the Privacy Policy. Privacy requests remain available independently of workspace closure.

Credits and refunds

One usage credit represents one U.S. cent of prepaid use. Members and API clients share their workspace balance. Pricing and credits describes operation prices and restrictions. A later price change does not reprice an accepted operation.

Included plan credits refresh monthly on monthly and annual plans. Unused plan credits expire at the end of their credit period. Purchased top-up credits do not expire while the workspace exists. They require an eligible paid plan to spend. They remain on the workspace after a plan lapses and become usable when an eligible plan resumes. Plan credits are used before purchased credits. Promotional credits have no cash value, except where law requires otherwise.

Subscription payments and delivered top-ups are generally nonrefundable. Exceptions apply where law requires a refund or a signed agreement provides otherwise. We also correct billing errors and duplicate charges. This provision does not authorize erasing an unresolved paid top-up balance on closure.

Benchmark reserves credits before paid work and settles the accepted price at completion. Failed or never-started operations release their reservations to their original credit pool, with original expiry conditions. Credit release is not a cash refund. An accepted Enriched operation may cost more when media quantities become known. A completed result may be delivered with a credit amount owed. New paid work is blocked until that debt is covered. Spending limits restrict new admissions, not the final price of accepted work.

A payment refund may reverse credits funded by that payment. Money credits from qualifying subscription changes are separate from usage credits. Plan and add-on changes take effect as shown at confirmation. Immediate Enterprise add-on removal stops its features without a routine refund of unused time, subject to applicable law and signed terms.

Inputs, permitted use, and ownership

You retain rights you hold in information you submit. You give Benchmark a non-exclusive right to process it as needed to provide, secure, support, and operate the Service and meet legal obligations.

You must have the rights and permissions needed for your inputs and use of results. Follow applicable law, these Terms, and the Acceptable Use Policy. Do not use results for harmful surveillance, high-impact eligibility decisions, spam, or a competing raw-data product.

Benchmark and its licensors own original software, design, documentation, and editorial materials. Your permitted access does not transfer ownership. Do not copy, resell, reverse engineer, or interfere with the Service except as law, documented permissions, or our written authorization allows. Authorized API use is permitted within documented limits. It does not authorize scraping or bulk republishing the gallery.

Send public-content privacy requests to privacy@benchmark.app. Send copyright or other legal concerns to legal@benchmark.app. You do not need an account to contact us. See Public Data and Removal Requests for request information.

Suspension and service changes

We may limit or suspend access where reasonably needed to address nonpayment, security, legal requirements, or material misuse. We may terminate access for material violations. We will provide notice and an opportunity to resolve a violation where appropriate. Urgent security, legal, or harm concerns may require immediate action.

We may change the Service. Material adverse changes to paid services remain subject to applicable notice requirements and signed agreements. Payment obligations, ownership, use restrictions, disclaimers, liability, and dispute terms survive termination where their nature requires it.

Disclaimers and liability

To the extent permitted by law, the Service is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not exclude warranties or remedies that law does not permit us to exclude.

Neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service, where law permits this exclusion. Each party’s total liability is limited to the greater of $1,000 or fees paid or payable for the Service during the preceding 12 months. The period ends at the event giving rise to the claim. These limits do not apply to properly owed fees, fraud, willful misconduct, or liability that cannot lawfully be limited. Mandatory consumer rights remain intact.

Where law permits, you will defend and indemnify Benchmark against third-party claims caused by your unlawful inputs or material prohibited use of the Service. This obligation covers reasonable resulting losses and costs. It does not cover Benchmark’s own sourcing, processing, or display of public content. An exception applies to the extent your unlawful inputs or prohibited use caused the claim. Benchmark will give prompt notice and reasonable control of the defense. Benchmark may participate and reject a settlement that imposes obligations on it without its consent. This provision does not impose obligations that applicable consumer law prohibits.

Enterprise agreements and data processing

A separately signed agreement or order form controls the services, fees, and matters it expressly covers. These Terms govern remaining matters. A signed data processing addendum controls conflicts concerning the specific processing it identifies. A customer relationship alone does not make all public-content research processing subject to a data processing addendum.

Changes, law, and notices

We may revise these Terms prospectively and will post the revised version and effective date. For material changes affecting paid services or rights, we will provide advance email or prominent product notice when practicable and as required by law. We will seek affirmative agreement when required. You may stop using the Service and cancel renewal if you do not accept a change.

Delaware law governs, subject to mandatory rights under the law where you live. Disputes belong in Delaware state or federal courts unless mandatory law gives you another forum. Nothing here waives rights that cannot lawfully be waived.

If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision once does not waive future enforcement. We may send account and legal notices to your account email or through the Service.
